TeacherCommentsGenerator is an AI-powered service that helps educators generate personalized, meaningful teacher comments for students. The Service uses artificial intelligence to create comments based on user-provided information about students. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

3. User Accounts and Registration

• You must be at least 18 years old or have parental consent to use the Service.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate, current, and complete information during registration.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights

5. Credits and Payment Terms

• Free Credits: New users receive 10 free credits upon registration. These credits have no expiration date.
• Purchased Credits: Credits can be purchased through our pricing plans. All sales are final unless otherwise stated.
• Credit Usage: Each comment generation consumes one (1) credit. Credits are non-refundable once used.
• Payment Processing: Payments are processed through Creem.io. By making a purchase, you agree to Creem.io's terms and conditions.
• Refunds: Unused credits may be eligible for refund within 30 days of purchase, subject to our refund policy. Used credits are non-refundable.
• Price Changes: We reserve the right to modify pricing at any time. Existing credits are not affected by price changes.

6. Intellectual Property

Service Ownership: The Service, including all content, features, and functionality, is owned by TeacherCommentsGenerator and is protected by international copyright, trademark, and other intellectual property laws.

Generated Content: Comments and images generated through the Service are provided for your use. You retain ownership of the input data you provide, and you may use the generated content for educational purposes. However, you may not:

• Resell or redistribute generated content as a service
• Claim ownership of the AI generation technology
• Use generated content in a manner that violates these Terms or applicable laws

7. User Content and Data

Your Responsibility: You are solely responsible for the student information and content you provide to the Service. You represent and warrant that:

• You have the right to provide such information
• You comply with all applicable privacy laws (including FERPA, COPPA, GDPR, etc.)
• You have obtained necessary consents for processing student data
• The information you provide is accurate and not misleading

Data Processing: By using the Service, you acknowledge that student information will be processed by our AI service provider (Replicate) to generate comments. We take reasonable measures to protect data but cannot guarantee absolute security.

8. Disclaimers and Limitations of Liability

Service "As Is": The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• Generated comments will meet your specific requirements
• Any errors will be corrected
• The Service is free from viruses or harmful components

Limitation of Liability: To the maximum extent permitted by law, TeacherCommentsGenerator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

9. Indemnification

You agree to indemnify, defend, and hold harmless TeacherCommentsGenerator, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service, violation of these Terms, or infringement of any rights of another party.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Non-payment of fees (if applicable)
• Extended period of account inactivity

Upon termination, your right to use the Service will cease immediately. Unused credits may be forfeited unless otherwise specified in our refund policy.
